Terms of Use

The agreement between you and Eversight Studio LLC covering Torq, the Torq Pro subscription, the data you export, and the limits of what a phone speedometer can promise.

1. Agreement

These terms govern your use of Torq, a GPS speedometer and driving telemetry app operated by Eversight Studio LLC ("we", "us"). By using Torq you agree to them. If you do not agree, do not use Torq. These terms mirror the terms the app links to at eversight.io; if they ever differ, the later date governs.

2. What Torq provides

A live speedometer, route recording, trip replay, driving telemetry, scorecards, exports and related features. Features depend on your device, iOS version, permissions, sensor availability, GPS quality, network access and subscription status, and may vary by region.

3. Safety and responsible use

Torq is designed for passive recording. Do not interact with your phone while driving. You are solely responsible for safe vehicle operation, for obeying traffic laws, for road conditions and for how the device is mounted.

Torq's readings are informational and for personal use. Torq is not an approved measuring instrument, a navigation system, a vehicle safety system, an insurance rating product, a law-enforcement device, or a substitute for your own judgment. The accuracy page describes the known limits of GPS speed.

4. Permissions and data

Some features need location, motion, notification, Live Activity, Picture in Picture or network permissions. Denying or disabling a permission limits the corresponding feature. How Torq handles data is described in the privacy policy.

5. Torq Pro and subscriptions

Torq may offer paid subscriptions, trials or other in-app purchases through the Apple App Store. Prices, periods, trial availability, renewal terms and cancellation instructions are shown in the app and by Apple at the time of purchase. Subscriptions are billed and managed by Apple; you can manage or cancel them in your Apple Account settings, and refund requests are handled by Apple under Apple's policies. We use RevenueCat to verify entitlement status and restore purchases.

Payment is charged to your Apple Account when you confirm a purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account may be charged for renewal within 24 hours before the period ends.

6. Your content and exports

You are responsible for the trip records, sensor files, routes, exports and other content you create, store, share or transmit with Torq. Review an exported file before sharing it; it can contain sensitive location, route, timing, speed and sensor data.

7. Acceptable use

You agree not to:

  • use Torq in a way that violates laws, regulations or third-party rights;
  • use Torq while driving in a way that distracts you or creates unsafe conditions;
  • attempt to reverse engineer, disrupt or misuse Torq or its services;
  • use Torq data to make legal, insurance, employment or safety-critical decisions without independent verification;
  • submit false, misleading, harmful or unlawful information to us or our service providers.

8. Third-party services

Torq relies on third-party services, including Apple, RevenueCat, Firebase, Meta and map data providers such as OpenStreetMap. We are not responsible for third-party services, data sources, outages, terms, policies or content.

9. Changes and availability

We may modify, suspend or discontinue features at any time, and may update the app for performance, security, compatibility or compliance. Some features may be experimental.

10. Intellectual property

Torq, including its software, design, branding, content and related materials, is owned by Eversight Studio or its licensors and protected by intellectual property law. These terms do not transfer ownership of Torq to you. Your own trip data is yours.

11. Disclaimer of warranties

Torq is provided "as is" and "as available" without warranties of any kind, express, implied or statutory. We do not guarantee that Torq will be accurate, uninterrupted, error-free, secure or available for every route, device, vehicle or region.

12. Limitation of liability

To the fullest extent permitted by law, Eversight Studio LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill or other intangible losses arising from or related to your use of Torq.

13. Indemnification

You agree to indemnify and hold harmless Eversight Studio LLC and its officers, directors, employees, contractors and agents from claims, liabilities, damages, losses and expenses arising from your use of Torq, your violation of these terms, or your violation of any law or third-party right.

14. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

15. Changes to these terms

If we change these terms materially we will update the date at the top and give notice as the law requires. Continued use of Torq after a change takes effect means you accept the updated terms.
